Get Clear Guidance for Medicaid Planning

As our loved ones age and their care needs increase, there are not only emotional challenges, but also long-term care costs that could wipe out a lifetime of savings. We will ensure your costs are covered by Medicaid.

South Florida nursing homes can typically cost between $8,000 and $10,000 per month. Medicaid is a government, need-based program that is designed to pay for the majority of long-term nursing care costs, and most South Florida nursing homes and hospitals accept Medicaid benefits.

In order to qualify for Medicaid, the nursing home resident is required to meet the following three key tests:
  1. A medical needs test: Needing help with several activities of daily living (ADLs) such as dressing, bathing, using the bathroom, walking, transferring from one seated position, and memory or cognitive functions.
  2. An income test: Having gross income up to $2,382 (2021 income cap) or have a properly created and funded Qualified Income. Only Trust (also known as a "Miller" Trust).
  3. An asset test of countable assets under $2,000. Most clients who come to Todd R. Zellen, P.A. are over the limit in countable assets. This is where our knowledgeable planning and experience can make a world of difference.

Role of the Elder Law Attorney During Medicaid Planning

The first point of contact with our office is usually when there is a crisis or signs of pre-crisis (such as a diagnosis of dementia or Alzheimer's) and immediate or foreseeable long-term care needs may be needed for a loved one.

Our legal representative will take the time to get to know you and your family and put together a plan that can protect the assets of your loved one needing care, and legally make countable assets into noncountable assets to secure Medicaid eligibility.

Medicaid planning gives frail seniors the opportunity to have better care by subsidizing the cost with government Medicaid dollars. Protected assets can often be used to provide your loved one with additional care, letting them age with dignity and better quality of life.

We believe that from the initial contact with our office, you will know you are in the right hands. We take plenty of time to understand the challenges you and your loved ones are facing. You will receive well-thought-out answers for any questions you may have.

We pride ourselves on our ability to deliver professional elder law advice with a caring and compassionate touch! Let us help make this difficult time a lot easier to deal with.
